I actually never thought of it this way, but you're right. My son plays EQ, and he's 9, clicks right on past the "ACCEPT" every time. According to their "EULA" an adult, or at their discretion, their minor child can play the game. But... to stretch your point out a bit further...what if I didn't use MQ2, but my son found a way to download it and use it? Clicks accept, loads up MQ2, goofs off with my toons (I'll beat his behind if I ever actually catch him doing this LOL) and bam I get ban-whacked. There's so many "what-ifs" in this digital world nowadays. But no, it's not worth taking to court over. I sat down the other day and added up all the $$ I've invested, in one way or another, in EQ over the last 5 years. I stopped counting, horrified, at $6k. Not all of that 6 g's went to SOE, mind you

but the end result was still the same. And while I"m no uber 6-account, 24/7 player, I hold my own. So if I've invested that much over the span of 5 years for a game I enjoy, can you imagine what the TOP players have spent?? I think SOE would be incredibly stupid to start whacking these folks with the ban-bat.
I don't use MQ2 for ghosting, warping (well ok it does make it easier to get to my guild if i'm late for a raid but that's it), etc... so my chances are pretty slim (at THIS point) of ever getting banned. Plus, as I've said before, I'm not 100% MQ2-compatible

as in I don't know how to use a lot of that stuff. I mostly use the forage macros, to filter the junk I don't want. Do you really think SOE is going to throw me for that? Not likely.
I did get into a rather heated discussion with them about a year ago over my use of the Nostromo Speedpad. I use it not only because I have Carpal Tunnel Syndrom and it makes repetitive tasks (casting, etc) much easier, but I also used it to forage. GM popped on one night, and I was afk. They suspended my account. I bitched. The EULA states no Third Party Programs. Technically, the gamepad is an adaptive device. So I was afk? Hmm could I have fell asleep, perhaps? They have no way of knowing that. I got my account back, a month's subscription paid, and a brief "form letter" apology. Never have been bothered since.
My Guild Leader loathes using MQ2, but since a good number of us in the guild uses it, his stance is "If you're stupid enough to get yourself caught, you gotta live with the consequences..just not in THIS guild."
<shrugs> Works for me.... and no, I probably wouldn't play EQ without MQ2 either.
